PARTICULAR TERMS OF SERVICE
These Terms and conditions apply only for particular works, such as gifts, art for yourself, and luxuries.
If I sent you this page is because I want you to READ IT and UNDERSTAND IT before paying me for a commission.
All my terms and conditions are based on experiences.
You must be at least 16 y/o to place a commission (you need to be 18 and over to place an NSFW commission) and, of course, you need to have the funds to pay me (even if we agreed for a payment plan)Payment is PAYPAL AND KO-FI ONLY, and only payments on USD currency,
make sure it says USD when you make the payment, or at least use google to convert USD to MXN
since Paypal Mexico only gives MXN as a reference of payment.You only have 3 opportunities to make any changes for FREE, you can spend them on one phase
or spend them on each phase (Phases: Clean sketch, Lineart, Colouring)After these 3 opportunities any aditional change will cost 10 USDYour chances for revisions+changes will be revoked if you make too many changes, even if you pay for themOnce paid, NO REFUNDSI'll send you a WIP/preview of your drawing in each phase, and you'll need to answer as fast as possible.If I ask for references or feedback from you and you haven't responded in a month, your comm will be paused and you WON'T be eligible for a refundAfter the sketch is approved and after my job is done, there are NO BIG CHANGESOnce the final file has been sealed and delivered, NO CHANGES, NO REFUNDSTry to be as specific as possible, send me reference images if needed, I can't read minds,
if your description is "I'll leave it up to you", I'll NOT apply any change requestsI WON'T start working if I don't receive any payment FIRST,Please do NOT rush me. I'm a person just like you.Passive rushing is not tolerated, the more you do it, the bigger the chances to get blacklisted
|| Passive rushing is making comments about your commission when its not your turn on the queue, asking for updates is fine Examples of each case:
X: "I want the background color yellow", "Maybe some cute sparkles would be nice" when your commission is at the bottom of the queue and I haven't contacted you for review
✔: "Hey! How's my commission doing?" "Any updates on my commission?"
The more frequent the passive rushing gets, the sooner you'll end up on blacklistCreating multiple accounts to evade blacklist will only provide me with more evidence to add to your document and will make me refuse to work with you entirely

You WON'T delete messages in our conversation. This is to avoid any further problems between your commission and my workflow, deleting messages can be seen as a method of incrimination, and if I catch you deleting them, I'll be taking screenshots for future documentation if needed

You can upload my drawing to your social media, BUT you'll need to credit me
(tag me) on the post at least onceYou WON'T erase my watermark on the drawing and you WON'T edit my final workYou WON'T SELL AND/OR MINT my artwork as an NFTYou WON'T SUBMIT ANY OF MY DRAWINGS INTO AN AIAny changes to the TOS while you're waiting for your comm will be applied to your order, with no exceptions.I'll send you the high-quality commission through a link on Google Drive.
Feel free to ask me again for it if you lost it!If within 2 months I haven't heard anything about your commission/directions, you WON'T be eligible for a refund

COMERCIAL TERMS OF SERVICE
These Terms and conditions apply only for big projects, such as illustrations or animations for promotions/events.If I sent you this page is because I want you to READ IT and UNDERSTAND IT before paying for a commission.
All my terms and conditions are based from experiences.
You'll need to pay +70% of the final price to gain the commercial use of my commissionsYou must be at least 16 y/o to place a commission (you need to be 18 and over to place an NSFW commission) and, of course, you need to have the funds to pay me (even if we agreed for a payment plan)Payment is PAYPAL AND KO-FI ONLY, and only payments on USD currency,
make sure it says USD when you make the payment. I do NOT accept any cryptocurrencyDO NOT add any message/notes into the payment once you pay for your commissionOnce paid, NO REFUNDSOnce the final file has been sealed and delivered, NO CHANGES, NO REFUNDSYou'll only have 3 opportunities to make any changes for FREE, you can spend them on one phase
or spend them on each phase (Phases: Clean sketch, Lineart, Colouring)After these 3 opportunities any additional change will cost 5 USD, and after 3 changes of 5 USD,
any change will cost to 20 USD, keep doing more changes and the price will rise even more
(see the FAQ for more info about this)I'll send you a WIP/preview of your drawing in each phase, and you'll need to give feedback in less than 24 hours, if you don't reply in 24 hours I'll take it as if you don't want any changes and I'll proceed to do my workIf I ask for references or feedback from you and you haven't responded in a month, your comm will be paused and you WON'T be eligible for a refundAfter the sketch is approved and after my job is done, there are NO BIG CHANGESTry to be as specific as possible, send me reference images if needed, I can't read minds,
if your description is "I'll leave it up to you", I'll NOT apply any change requestsI WON'T start working if I don't receive any payment FIRSTI DO NOT work on Sundays, Sundays are my rest days;
if you want me to work on Sunday, that'll cost 50 USDRushing me constantly will cost you 100 USDMaking me work for nothing (Making a sketch but then not buying anything/forgetting about the whole project) will cost you 25% of the FULL PRICE + the number of changes I have registered on my changelogIf I don't hear anything about any of your ideas for the comm in TWO WEEKS to finally proceed, I'll discard the idea.

STORE TERMS OF SERVICE
These are the Terms of Service for my Etsy Store
They are quite different from my usual TOS
You must be at least 16 y/o and/or have permission from your parents to place an order from my storeCustom products are made by order and they can't be refunded or changed once the order it's done, for more information, I recommend reading my artist's TOS at https://vgen.co/MimnyMy acrylic products may come with a protective film to keep them from being scratched. This film may appear scratched, but if you remove it your charm will be shiny and unharmed. Please remember to remove that film!
(Sometimes that film has been already taken off, it depends on the product)If you are planning to give your purchase as a gift, please order at least a month in advance
If you need me to wrap a present or write something on a card, lemme know!
- Wrapping includes a handmade envelope (random color) and some extra freebies (depending on the item you have purchased, some products don't include freebies)
- I won't be making packages that exceed the size of the shipping envelopeFor those with allergies, I do not have animals living with me, I do not have food or snacks when assembling/handling merch and packages, and I do wash my hands regularly, so your products are safe to touch!Some listings have alternate designs or items available in the listing drop-down menu. You must pick the items you want from the drop-down menu and add them to your cart individually. Buying one item does not mean you are getting all items pictured, so please choose which items you would like to purchase.Handmade products, I literally made them with my own hands, they may not be perfect, but they are made with love, some pieces (like back clutches or seams) can fall off, but you can repair these with superglue. PLEASE FOLLOW THE CARE AND REPAIR INSTRUCTIONS ATTACHED TO YOUR ORDER

❗️ I, as the seller/store, cannot be responsible for packages misplaced or lost by courier services. Please do not place any orders if this is unacceptable to you. Delivery issues should be reported to your local courier service, as I am in no way associated with them and cannot control any aspect of the delivery process.I will not offer refunds or redeliveries for lost or damaged goods since it is completely out of my control once I drop it off the post office. My item arrived broken/my item broke with time, can something be done?
Each package has care and repair instructions, I advise you to please follow those first
If you think your order is damaged beyond repair, please send me a message with image proofs so we can reach a solution (refund or replace the item for free)I wasn't home when my package arrived, and now it's returning to sender, help!
Once your package is returned to us, I'll be asking if you want the package to be re-sended to the same address
Returned packages can only be re-sended for free ONCE
Failing to reply to the inquiry may result in voiding your orderCan you make my order arrive faster?/Can I choose my shipping carrier?
Orders are usually sent with Correos de Mexico, and once it touches your country, it will transform into the public postal service (USPS, RoyalMail, ANPost, etc)
If you require another carrier, please send me a message so I can quote it for youWhy do you ship once per month?
I do not live in the city, most of the post offices don't respect the prices, and the one I know that respects set prices, and I have friends working in there, it's a bit far from where I am... It's easier for me to gather all the month's packages in a batch, then hand them to the post office all at onceAny changes to the TOS while you're waiting will be applied to your order, with no exceptions.
Failing to read/using common sense about these rules will lead to blacklist and voided garantee
"I didn't know" is not a valid excuse
ADOPTABLE TERMS OF SERVICE
These are the Terms of Service for my Adoptables
They are quite different from my usual TOS
You MUST be at least 16y/o to buy an adoptable from me.The payment is made upfront.
PAYPAL AND KO-FI ONLYI'll need your Paypal email for the invoice, this can be sent to me via DM or email as needed.You will have a maximum of 48 hours to complete the payment before canceling the process and losing the rights to the character.I'll send the transfer or the files ASAP after the payment. The maximum estimated time of arrival can be of 48 hours. This maximum of a tie is only in case the payment has not arrived or if for personal details I'm not near the computer. In any case, you are free to send me any DM to any of my social media.Once paid, NO REFUNDSThey can be gifted.They can be traded.They can be redesigned as long as they hold their principal features (Color palette)
You can change anything of the design as your heart's content, so you don't need to keep the original name/bg it has.You can modify the design, NOT the art I madeYou WON'T erase my watermarkThey cannot be sold for a higher value without any extra artwork (your artwork doesn’t count).You can't just redesign them and sell them.DO NOT SELL MY DESIGNS FOR MONEY IF YOU HAVENT PAID FOR THEM ORIGINALLY.You WON'T sell/trade/gift my designs to anyone in my BLACKLIST.I don't do refunds.If you don't want to keep an old design you can return it to me to keep it or you can give it way in any oc bank or activity, just remember that I will not refund the money/virtual currency if is that the case.Cannot be used/minted for NFTs, you are buying the design/idea not the art itself.You WON'T SUBMIT ANY OF MY DRAWINGS INTO AN AIThe design/concept can be used for any of your personal and commercial projects like RP ,indie games, merch and others.You WON'T print or use the art I made for the adoptable with for commercial uses, make your own art.Any changes to the TOS while you're waiting for your adoption will be applied to your order, with no exceptions.
